OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

If any document is found u n readable, the bid is liable to be rejected. • Earnest Money Deposit (EMD) – The bidder shall submit the EMD as specified in the bid document. Th e original EMD must be deposited in the office within 5 days from the date of opening of Bid on GeM portal. EMD exemption will be granted only to eligible Micro & Small Enterprises, Start-up registered with MS ME i n accordance with Uttar Pradesh Government Order No. 57/18-2-2024-97(L.U.)/2016 dated 26-11-202 4. Tr aders are excluded from the purview of this policy. • OEM Authorization – The bidder must be either the Original Equipment Manufacturer (OEM) or an auth orized distributor of the OEM. Only one distributor authorization per OEM is allowed; multiple distributors fo r the same OEM will be rejected. • Experience – The bidder must submit a Purchase Order for the same make and model, as offered in the GeM bid, issued by any Government/Semi-Government/PSU institution, either in their own name or in the name of another authorized distributor. • ATC Compliance – Acceptance of the Additional Terms & Conditions (ATC) must be submitted along wit h the duly signed bid document. • Turnover Certificate – The bidder must furnish a Turnover Certificate for the last three financial years, issued with UDIN. • GST Registration – A valid GST registration certificate must be submitted. • Offered Product Details – A declaration must be submitted for the offered product, indicating the Mak e, Model, and date of introduction of the model. · Model Certificate – OEM must provide an affidavit (for Indian OEM) /declaration (for Foreign OEM) confirm ing the offered model is the latest. • Product Catalogue & Compliance – The bidder must upload the original catalogue of the offered prod uct and a compliance sheet confirming adherence to the attached technical specifications. The Make & Mo del listed on the GeM catalogue must match the offered product. · Certifications – All certificates required i n the product specifications (as mentioned in the ATC file) must be provided.· In accordance with GeM GTC Clause 26 related to restrictions on procurement from bidders f rom countries sharing land borders with India, such bidders must be registered with the Competent Author ity. A compliance undertaking must be submitted. Any false declaration shall lead to immediate terminatio n of contract and legal action as per law. • Service Centre – The bidder must provide details of their service centre located in the region. • Price Bid – The Financial Bid must include complete scope of supply, price breakup of all items, and det ailed lists of accessories, consumables, and spares for the quoted product, uploaded in PDF format under t he financial bid section on the GeM Portal. • Rates of Spares & Consumables – The bidder must quote item-wise rates of all spares/accessories/co nsumables separately (PDF). The quoted rates shall remain valid for 10 years (during warranty & CAMC pe riod) for future procurement as required. • Mandatory Supply of Unquoted Items – If any required spare/accessory/consumable is not quoted, t he same must be supplied by the bidder free of cost, without any condition. • Affidavit on Non-Judicial Stamp Paper of ₹100/ - Lowest Price Certificate – The bidder shall certify that the quoted prices are the lowest and that the sa me make & model has not been supplied at lower rates to any organization. If the bidder has not supplied i t, a relevant Purchase Order issued to another distributor may be submitted, but the OEM must provide t h e lowest price affidavit. Non-Blacklisting Certificate – Declaration that the firm has not been blacklisted by any Government/Se mi-Government institution in the last three years. Document Authenticity Declaration – Confirmation that all documents submitted are genuine; any fals e submission may lead to legal action. Right of Acceptance/ Rejection – The Principal, SMMH Govt. Medical College, Saharanpur reserves full r ight(s) to accept, reject, or cancel any or all e-bids, or annul the biddin g process at any stage without assigning any reason. • Pagination & Authentication – All pages of the bid, annexures, and enclosures must be serially numb ered, duly signed, and stamped by the bidder. Total number of pages must be clearly indicated in the Tec hnical Bid. One online UPS and one dialyzer holder rack must be supplied with each dialysis machine. .
